1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Valpero website monitoring service ("Service") operated at https://valpero.com. By registering an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service.

Minimum age: You must be at least 16 years old to use the Service. By using the Service, you confirm that you meet this requirement. If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Valpero provides automated uptime monitoring, SSL certificate checks, response-time tracking, and alert notifications for websites and services you configure ("Monitors").

Services are provided according to the plan you select. Plan limits (number of monitors, check frequency, etc.) are described on the Pricing page.

We aim for 99.9% availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance where possible.

3. Accounts and Responsibilities

3.1. You are responsible for maintaining the security of your account credentials.

3.2. You agree to:

  • Provide accurate information when registering;
  • Only add monitors for websites or services you own or have explicit permission to monitor;
  • Not use the Service to probe, scan, or test systems without authorisation;
  • Not resell, sublicense, or redistribute access to the Service;
  • Not take actions that interfere with the operation of the Service or other users.

3.3. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Plans, Billing, and Payments

4.1 Subscriptions

Paid plans are billed on a recurring basis (monthly or annually, as selected). By subscribing, you authorise us to charge your payment method on the recurring schedule until you cancel.

4.2 Free plan

The Free plan is provided at no cost with limited features. We may change the Free plan's limits with 30 days' notice.

4.3 Price changes

We will notify you of price changes by email at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the new pricing.

4.4 Payment processing

Payments are processed by Lemon Squeezy LLC ("Lemon Squeezy"), who acts as the Merchant of Record. Card data is handled exclusively by Lemon Squeezy and never stored on our servers. By making a payment you agree to Lemon Squeezy's Terms of Service.

5. Cancellation and Refund Policy

5.1 Cancellation

You may cancel your paid subscription at any time from your account Settings page or by emailing [email protected]. Cancellation takes effect at the end of the current billing period. You retain access to paid features until then.

5.2 Refunds

We offer a 7-day money-back guarantee on your first payment for any paid plan. If you cancel within 7 days of your initial subscription payment and have not used the Service excessively, contact us at [email protected] for a full refund.

Outside of the 7-day window, subscription fees are non-refundable except where required by applicable law.

5.3 Right of withdrawal (EU consumers)

If you are an EU/EEA consumer, you have a statutory right to withdraw from a digital service contract within 14 days of subscription without giving any reason (EU Consumer Rights Directive 2011/83/EU, Art. 9).

Important: By completing your subscription and accessing the Service, you expressly request that we begin providing the Service immediately. If you withdraw within 14 days and have already used the Service, we may charge a proportionate amount for the period of use before withdrawal.

To exercise the right of withdrawal, contact us at [email protected] with the subject "Right of Withdrawal" before the 14-day period expires.

6. Intellectual Property

All content, software, design, and databases of the Service are the exclusive property of Valpero or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

You retain all ownership of the content and URLs you submit as monitors. By using the Service you grant us a limited licence to access those URLs solely for the purpose of providing the monitoring service.

7. Disclaimer and Limitation of Liability

7.1. The Service is provided "as is" and "as available". We make no warranties, express or implied, regarding accuracy, reliability, or fitness for a particular purpose.

7.2. We are not liable for any indirect, incidental, or consequential damages arising from use or inability to use the Service, including but not limited to lost revenue, lost data, or business interruption.

7.3. Our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the 3 months preceding the claim.

7.4. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

7.5. Uptime monitoring results depend on third-party network infrastructure. A false "down" or "up" reading does not constitute a breach of contract on our part.

Note for EU consumers: The limitations above do not affect your statutory consumer rights under applicable EU law. EU consumer protection law may provide you with rights beyond those described here.

8. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you by email at least 30 days before the changes take effect. For non-material clarifications, we may update without prior notice.

If you are a paid subscriber and the changes materially affect your rights, you may cancel your subscription before the effective date for a pro-rata refund of any prepaid fees.

9. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account for violation of these Terms, with or without notice depending on the severity of the violation.

Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where the operator is established. Any disputes that cannot be resolved through good-faith negotiation will be submitted to the competent courts of that jurisdiction.

EU consumers: Nothing in this clause prevents you from bringing claims before the courts of your country of residence, and you retain the benefit of any mandatory consumer protection provisions of your local law. You may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
